The website accessible at www.medibee.ca (the "Website") is owned and operated by Oxmo Canada Inc. (the "Company", "Medibee", "we", "our", or "us").
These Terms of Use constitute a legal agreement between the user of the Website ("you", "your") and Medibee. They define the conditions under which Medibee allows you to access and use the Website Content (as defined in Article 3).

BY ACCESSING THIS WEBSITE, YOU ACCEPT THESE TERMS OF USE. Please read this document carefully and in its entirety. Your use of the Website must comply with these Terms and all applicable laws, including copyright and trademark laws. If you do not agree with these Terms, please stop using the Website.

1. Secure Platform and access to pharmaceutical services
The Website provides access to a secure platform (the "Secure Platform") that allows you to interact with healthcare professionals associated with pharmacies that offer advice and other services (the "Participating Pharmacies"). Each Participating Pharmacy is independent of Medibee (unless expressly stated otherwise) and offers its services on the Secure Platform in its own name.
In addition to these Website Terms of Use, your use of the Secure Platform will be governed by the Secure Platform Terms of Use. The services of the Participating Pharmacy of your choice may also be subject to the terms and conditions of that pharmacy. Please inquire with the Participating Pharmacy about this.
2. Health content and pharmaceutical services
2.1 Information available on the Website is for informational purposes only
In case of a medical emergency, immediately contact a doctor or healthcare professional.
The Website contains health information and general healthcare advice, but does not offer personalized medical or pharmaceutical advice. The health content of the Website does not replace consultation with a healthcare professional. Only a healthcare professional can diagnose or treat a health problem. You should discuss your health condition with a doctor, pharmacist, nurse, or other authorized healthcare professional before applying any general information from the Website.
Any medication or natural health product may cause serious side effects or interactions. You are responsible for verifying information regarding dosage, precautions, warnings, interactions, and contraindications of any medication, natural product, tool, or method mentioned on the Website. Carefully read the manufacturer's instructions and consult your pharmacist when purchasing medications or natural health products. Keep all medications and natural health products out of reach of children.
Medibee cannot under any circumstances be held responsible for the consequences resulting from your use of the general health information presented on the Website.
2.2 Your exclusive relationship is with the Participating Pharmacy
Using the Website does not create a patient-pharmacist relationship between you and a Participating Pharmacy or its healthcare professionals. This relationship is established only when you communicate with a Participating Pharmacy through the Secure Platform. You become a customer of a Participating Pharmacy when you consent to a file transfer, request the execution of a prescription, or accept a consultation with a pharmacist.
Medications and pharmaceutical services (including professional advice) are offered and executed exclusively by the Participating Pharmacies. Medibee does not offer medications or pharmaceutical services — we only provide a secure platform to facilitate your relationship with the Participating Pharmacy of your choice. The exchange and protection of personal information are governed by our Privacy Policy. Your relationship with the Participating Pharmacy may be subject to the conditions and privacy policy of that pharmacy; please inquire about this.
3. Intellectual Property
All elements appearing on the Website are the property of Medibee or its licensors, including, but not limited to: information, content, documents, images, trademarks, trade names, reports, data, graphics, interfaces, web pages, texts, files, software, company names, logos, and all other materials (collectively, the "Content"), including the way the Content is presented.
You may browse the Website and view the Content in accordance with these Terms of Use (see Article 4), but all rights are reserved. No ownership rights, license, or other rights are granted to you, and any reproduction or use not expressly authorized must be subject to prior written authorization from Medibee (or the third-party rights holder).
4. Content Usage Restrictions
Subject to your compliance with these Terms, Medibee grants you a non-exclusive, personal, and non-transferable license to access the Website and Content for informational purposes only.
Medibee authorizes you to copy the Content only for your personal use or for internal use within your organization. This does not authorize distribution to third parties. This permission applies only if you: (i) retain all copyright, trademark, and other property rights notices displayed with the Content in any copy you make; (ii) do not modify the Content; and (iii) do not use the Content for commercial purposes.
Except as mentioned above, no Content may be copied, reproduced, republished, downloaded, posted, transmitted, or distributed without the prior written consent of Medibee.
Unless expressly authorized in writing by Medibee, no license or right is granted to anyone. No right, title, or interest in the Content (including Medibee or affiliated pharmacy logos or trademarks) is transferred to you, and Medibee reserves all intellectual property rights.
5. Purpose of the Website and warranty limitation
The primary purpose of the Website is to provide information about Medibee and about the products and services offered by the Participating Pharmacies. This information is provided for informational purposes only.
Although Medibee makes reasonable efforts to ensure that the information on the Website is accurate and up-to-date, it may sometimes be incomplete, contain errors, or be outdated. Before making decisions based on this information, you should verify it with another source or contact Medibee directly.
Changes may be made periodically to the Content of the Website. Medibee may improve or modify the products and/or programs described on the Website at any time without notice.
TO THE FULLEST EXTENT PERMITTED BY LAW, AND EXCEPT AS EXPRESSLY PROVIDED IN THESE TERMS, THE WEBSITE AND ALL ITS CONTENT ARE PROVIDED "AS IS", WITHOUT REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. 6. Limitation of liability
Medibee ASSUMES NO RESPONSIBILITY FOR THE USE OF THE WEBSITE AND/OR ITS CONTENT, NOR FOR ANY DAMAGE OR PROBLEM, REGARDLESS OF ITS NATURE OR ORIGIN, THAT MAY RESULT FROM THE USE OF THIS WEBSITE OR ITS CONTENT.
WITHOUT LIMITING THE FOREGOING, IT IS UNDERSTOOD THAT Oxmo Canada Inc. WILL NOT BE RESPONSIBLE FOR:
INDIRECT, PUNITIVE, OR EXEMPLARY DAMAGES, OR ANY ECONOMIC DAMAGE, INCLUDING LOSS OF PROFITS, SAVINGS, OPPORTUNITIES, DATA, OR COSTS OF DATA RECOVERY, REGARDLESS OF HOW THEY OCCURRED, EVEN IF WARNED OF SUCH POSSIBILITIES;
DAMAGES OR LOSSES RESULTING FROM: (A) VIRUSES, DATA CORRUPTION, TRANSMISSION PROBLEMS; (B) TELECOMMUNICATIONS SERVICE PROVIDERS; (C) INTERNET INFRASTRUCTURE; (D) THIRD-PARTY CONTENT, PRODUCTS, OR SERVICES; (E) DAMAGES CAUSED BY YOU OR YOUR EMPLOYEES, AGENTS, OR SUBCONTRACTORS; (F) LOSS OF INFRASTRUCTURE, COMPUTING RESOURCES, OR DATA; (G) INABILITY TO USE THIS WEBSITE OR ITS CONTENT; (H) ANY OTHER WEBSITE LINKED TO THIS WEBSITE; (I) EVENTS BEYOND THE REASONABLE CONTROL OF PARTICIPATING PHARMACIES, EVEN IF WARNED OF SUCH POSSIBILITIES.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE TOTAL AND AGGREGATE LIABILITY OF Medibee, REGARDLESS OF THE CAUSE (INCLUDING BREACH OF CONTRACT, TORT LIABILITY, NEGLIGENCE, OR OTHERWISE), WILL IN NO EVENT EXCEED ONE HUNDRED CANADIAN DOLLARS (CAD $100).
7. Indemnification
You agree to indemnify, defend, and hold harmless Medibee and its affiliated companies, as well as their officers, shareholders, directors, employees, agents, and representatives, against all claims, damages, liabilities, costs, and expenses relating to: a) any information or content you transmit to Medibee by email or other correspondence; b) your use of the Website content, including claims for intellectual property infringement.
8. Third-party sites
The Website contains links to websites operated by third parties ("Third-Party Sites"). These links are provided as a convenience, and your access to Third-Party Sites is at your own risk. Medibee makes no representations regarding Third-Party Sites, their condition, or the information they contain. Medibee assumes no responsibility for damages resulting from the use of links to Third-Party Sites or their content.
9. Privacy
Medibee collects and uses personal information in connection with the Website in accordance with applicable laws and its Privacy Policy.
10. Website control
Medibee reserves the right to monitor your use of the Website and the use of all other users. By accessing this Website, you consent to this monitoring. You acknowledge that Medibee is not obligated to monitor user activities and assumes no responsibility for user actions. Medibee reserves the right to limit your access to the Website at its discretion.

In case of dispute, the version of the Terms in effect at the time of the contested acts will govern the dispute.
14. Entire agreement
These Terms of Use (as amended from time to time) and all other legal notices and policies published on the Website constitute the entire agreement between you and Medibee regarding the use of the Website and Content.
Certain parts of the Content may be subject to different conditions that will be communicated to you when you access that Content. If other conditions are communicated for specific content, those conditions apply to that content and prevail over this Agreement. The terms of any downloadable software license will prevail over these Terms.
15. Severability
If a provision of this Agreement is found to be illegal, invalid, or unenforceable, it will be considered ineffective to the extent of such illegality, invalidity, or unenforceability and will otherwise be enforced to the fullest extent permitted by law, without affecting the other provisions of this Agreement.
16. Term and termination
These Terms of Use remain in effect for the duration of each access and use of the Website.
Medibee may limit, suspend, or terminate the activities or functionalities of the Website, or your access to them, at any time without notice.
Provisions that by their nature apply after termination will remain in effect after any termination or expiration of these Terms, including provisions concerning intellectual property, Content usage restrictions, warranty limitations, liability limitations, and indemnification obligations.
17. Applicable laws and competent courts
Medibee, the Website, and its Content (excluding Third-Party Sites) are located in the province of Quebec, Canada. This Agreement is governed by the laws of the province of Quebec and applicable Canadian federal laws, without reference to principles of conflict of laws.
Any dispute arising from your use of the Website falls under the exclusive jurisdiction of the courts of the province of Quebec.
18. Waiver of accessibility of products, programs, and services
The Website may list products, programs, and services from Medibee or third parties that may not be available in your country. The mention of these products does not obligate Medibee or the Participating Pharmacies to offer them in your country.

Carefully read the instructions, warnings, and brochures provided by the manufacturer, and consult your pharmacist before purchasing any medication or natural health product. Always keep medications and natural health products out of reach of children.

Pharmacy practice: The medications and pharmaceutical services presented on medibee.ca are provided exclusively by the pharmacists of Pharmacie Abd-el-monem Osman inc. affiliated with Medibee. In providing related services, they act exclusively on behalf of Pharmacie Abd-el-monem Osman inc. Certain conditions may apply; talk to your pharmacist.

The pharmacist owner Abd-el-monem Osman is solely responsible for the operations of the pharmacy.
